Alcohol
- It is unlawful for anyone under 21 years of age to purchase,
possess or consume alcohol. Even if alcohol is detected
on the breath, the minor can be in violation.
- It is unlawful to provide alcohol to a minor; if a party
is held at a home or other facility, parents or owners
may be face criminal and/or civil action resulting from
the actions of the minor.
Children
Under 17 Years
- Are generally considered a minor for criminal matters
- Are under the jurisdiction of the Juvenile Court
- Depending on the offense and past delinquency record,
prosecutors and public safety officials make a determination
whether to petition the court or apply diversion.
- Diversion allows the juvenile to be placed in counseling
and community service programs (usually through Youth
Assistance).
- The Berkley Public Safety Department will notify parents
if their child is detained.
17 Years
Or Older
- Considered an adult
- Juvenile procedures do not apply
Juveniles
May Be Treated As Adults
- Juveniles as young as 14 years of age may be tried as
an adult and given an adult sentence for serious crimes
such as murder, robbery, arson, narcotic sales, etc.
Curfew
- 16 years of age and under: 10:30 p.m. - 6 a.m.
- During curfew hours minors
are not allowed on public streets or in public places.
- Exceptions to this includes:
- a minor who who is in
the company of a parent or other family member who is
at least 18 old
- when coming from a school,
church or civic function providing the minor has parental
consent
- in the course of his/her
job
- The minor can be referred
to juvenile court for violating local curfew laws.
